U.S. individuals and businesses receiving income from Portugal may be asked to provide proof that they are U.S. tax residents before a Portuguese payer applies benefits available under the U.S.-Portugal income tax treaty.
For U.S. taxpayers, that proof may be Form 6166, the U.S. tax residency certificate issued by the IRS. Form 6166 is requested by filing Form 8802, Application for United States Residency Certification.
Portugal also uses its own treaty-relief documentation. In particular, Modelo 21-RFI is used for certain requests for full or partial relief from Portuguese withholding tax under an applicable double-tax treaty.
What Is Form 6166 Used for in Portugal?
Form 6166 certifies that the named taxpayer is a U.S. resident for federal tax purposes for the certification period shown on the certificate. It can provide the tax-residency evidence needed when a Portuguese payer or tax process requires proof that the recipient is resident in the United States for treaty purposes.
The certificate does not itself determine the Portuguese tax rate that applies to a payment. Treaty eligibility also depends on the type of income, the applicable treaty provision, and any other requirements imposed by Portuguese law or the U.S.-Portugal treaty.

What Is Portugal Form 21-RFI?
Portugal's tax authority uses Modelo 21-RFI for certain requests for full or partial exemption from Portuguese withholding tax under a double-tax treaty.
Portuguese guidance identifies dividends, interest, and royalties as typical types of income for which treaty provisions may eliminate Portuguese withholding or reduce the domestic withholding rate.
Modelo 21-RFI is completed by the beneficial owner of the Portuguese-source income, or by the owner's legal representative. It is then provided as part of the documentation supporting the requested treaty treatment.
Does Form 21-RFI Need a U.S. Tax Residency Certificate?
Portugal's tax authority states that Modelo 21-RFI must be accompanied by a certificate of tax residence issued by the competent authority of the beneficiary's country of residence.
For a qualifying U.S. taxpayer, Form 6166 is the IRS-issued document used to certify U.S. tax residency. The taxpayer first submits IRS Form 8802 to the IRS, and the IRS issues Form 6166 if the residency-certification request is approved.
The Portuguese documentation and the IRS application therefore serve different purposes. Form 8802 is filed with the IRS to obtain the U.S. certificate, while Modelo 21-RFI is part of the Portuguese treaty-relief process.
How to Request Form 6166 for Portugal
To request U.S. tax residency certification for Portugal, complete Form 8802 and identify Portugal among the countries for which certification is requested.

When Should You Request Form 6166 for Portugal?
Applicants should determine when the Portuguese payer or other requester needs the residency documentation before submitting Form 8802.
The IRS recommends filing Form 8802 at least 45 days before the Form 6166 certificate is needed. Actual processing times can vary, so taxpayers expecting a Portuguese payment subject to withholding may want to begin the certification process before the payment date.

How Long Is the Residency Documentation Valid in Portugal?
Portugal applies its own validity rules to the documentation used with Modelo 21-RFI.
Portuguese tax-authority guidance states that Modelo 21-RFI accompanied by a qualifying tax-residence certificate generally has a maximum validity of one year from the date the residence certificate is issued. However, the documentation also expires on the last day of the tax period identified in the residence certificate.
If the relevant certificate has expired, new valid residency documentation may be needed before a Portuguese payer can rely on it for treaty-based withholding relief.
The Portuguese rule should be distinguished from the broader question of how long can Form 6166 be used. A foreign jurisdiction or requester may impose its own documentation period even though the IRS certificate relates to a stated certification year.
Can Form 6166 and Form 21-RFI Be Sent Electronically?
Applicants should confirm the document-delivery requirements with the Portuguese payer or tax adviser before relying on electronic copies.
Portugal's tax authority states that electronic copies of Modelo 21-RFI and a tax-residence certificate received by email, including PDF copies, are not valid for purposes of obtaining full or partial withholding-tax relief under a tax treaty. The Portuguese withholding entity must possess the original written supporting documents.
This rule concerns the Portuguese use of the documents after Form 6166 has been issued. It is separate from the methods available for submitting Form 8802 to the IRS.
Does Form 6166 Automatically Reduce Portuguese Withholding?
Form 6166 establishes U.S. tax residency. It does not by itself determine that a particular payment is exempt from Portuguese tax or qualifies for a reduced withholding rate.
Portugal's tax authority explains that Modelo 21-RFI and the residence certificate support treaty relief only when the applicable double-tax treaty provides an exemption or reduced rate for the income involved.
The taxpayer and Portuguese payer therefore still need to determine the applicable treaty provision and whether the other conditions for the requested withholding treatment have been satisfied.
What if Portuguese Tax Was Already Withheld?
The documentation required after Portuguese tax has already been withheld can differ from the documentation used to obtain reduced withholding before payment.
A taxpayer seeking a Portuguese tax refund should confirm the applicable refund procedure, required Portuguese forms, filing deadline, and supporting documents before assuming that Form 6166 alone will be sufficient.
Form 6166 can establish U.S. tax residency, but it does not prove the amount of Portuguese tax paid or independently establish entitlement to a refund.
Can One Form 8802 Include Portugal and Other Countries?
A taxpayer who needs U.S. residency certifications for Portugal and other countries can generally list multiple countries on the same Form 8802 country worksheet.
The applicant specifies the number of certifications needed for each country and then enters the total number requested on Form 8802.
